Second DEP Letter Cites Stormwater Violations at Berkeley Heights Sewage Plant

Yesterday, I wrote about the township Sewage Plant being cited by the NJ DEP for inaccurate reports and partially treated sewage flow into the Passaic River.

This report was based on a set of documents a resident provided us that was published by the township in connection to the failed sewer bid.

That same packet contained a second letter from the DEP dated March 7, 2024 that cited the Township for serious failures under its stormwater permit.

The letter states that large chemical containers holding peracetic acid, Micro-C, magnesium hydroxide, and 55-gallon drums were stored outdoors on bare soil without cover or secondary containment.

The DEP found that this created a risk of chemicals getting into groundwater or storm drains when it rained. The DEP also found that annual facility inspections were not conducted or put in writing (for 2020 through 2022), staff training on stormwater pollution prevention was not provided and that routine inspections were not fully completed.

As a result, the DEP ordered the township to

-Immediately remove all uncovered materials from bare ground and provide proper secondary containment.

-Correctly document and submit all required stormwater inspections.

-Conduct staff training and update stormwater pollution prevention practices.

This letter is dated less than a month before the 04/24 DEP letter on overflows and reporting failures.

Together, the two documents point to potential systemic lapses in environmental compliance.

We are not through the entire packet yet and will report as more information is vetted.
