Correction – 02/26/2028: This article contains the following error: it states or implies that OPMA required the agenda or packet to be posted 48 hours in advance of this meeting. For a regularly scheduled meeting properly covered by the annual meeting notice, OPMA does not require advance public posting of the meeting agenda. John’s Notes on the New Providence 02/26/2026 BOE Agenda
NEW PROVIDENCE, NJ — The New Providence BOE posted the 02/26 (based on our review) meeting agenda after noon on February 25 which gives residents less than 48 hours to review the packet before the Board votes on several substantive matters, including $4,192,559.38 in district bills.
While being late on an agenda once in a while due to an unforeseen is certainly understandable, the response from the Business Administrator when we asked about it last month made it clear that this was the District’s typical practice.:
In an email exchange on 01/21/2026 he wrote….
“For tomorrow’s meeting (and every board meeting), the Board received the agenda packet on Tuesday afternoon. The agenda is posted on Wednesday afternoon for the meeting tomorrow. No agenda is posted without the review and an opportunity for the Board to get clarification on agenda items.”
And in a subsequent email, that same day he confirms…
“My email did not indicate or state that the Board receives a “finalized” agenda on Tuesday. A draft agenda and packet is sent Tuesday afternoon. Once the agenda is “finalized”, it is posted on the website on Wednesday. I hope you can understand and respect our process as it works for our school community.”
In other words, a “we review it Tuesday and post it Wednesday” workflow is not, by itself, a justification for consistently giving the families less than 48 hours to review what the Board plans to vote on.
I followed up with the New Providence BA again today, but this time I did not get a response.
On to the Agenda.
Finance…Still No Bill List
The February 26 agenda includes approval of:
- February 2026 payment of bills totaling $4,192,559.38
- January 2026 budget transfers totaling $27,385.54
- Contract and rate approvals connected to student services and evaluations
Although monthly bill approvals are routine, they represent significant public spending, and just like last month, there is no bill list published with the agenda for families to review before the meeting.

Request for a SEMI waiver, with the district estimating fewer than 40 Medicaid-eligible special education students for the 2026-27 school year
Approval of MindWell evaluation rates ranging from $2,500 to $5,000 depending on evaluation type- actual contract is not in the packet for the public to review
Resolution implementing a change to public notice publication procedures tied state law effective March 1, 2026.
Ongoing Transparency Questions
The district hasn’t indicated whether it plans to change its posting practices. With repeated late postings involving substantial public spending, the timing of agenda publication remains an ongoing transparency issue for residents and an OPMA compliance concern for the District.
